Introduction

This website, jatindua.com (the “Site”), offers information, products, and services related to real estate (the “Services”) provided by Jatin Dua, Realtor with RE/MAX Quantum Realty. We operate this website and may use third-party contractors to support the delivery of the Services and the Site (“Service Providers”).

If you are a visitor to this Site, this Privacy Policy and Terms of Use applies to you and describes our policies and practices regarding the collection, use, and disclosure of your personal information in connection with your use of the Site. We act as the controller of your personal data, and our Service Providers assist us solely in their capacities as service providers and data processors. We handle personal information in accordance with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA).

This Privacy Policy and Terms of Use does not apply to websites, applications, or other online services that do not link to this Policy. If you have questions about our use of your personal information, please contact us using the information in Section 12 below.

1. Personal Information We Collect

Information you provide to us: contact information such as your name, email address, home address, and phone number; feedback or correspondence when you contact us; marketing preferences and consents; and other information you provide voluntarily in connection with the Site or Services.

Information we obtain from third parties: social media information when you visit or interact with our pages on platforms such as Facebook, LinkedIn, Instagram, and YouTube (the platforms’ own privacy policies apply to their processing); data enrichment sources such as property and public records databases, demographic data providers, and publicly available information; and other sources such as analytics services and marketing partners.

CRM and communication data: if you communicate with us by email, text message, or other electronic means, or where we use customer relationship management (“CRM”) tools, we may collect and process message content and metadata, communication timestamps and delivery status, contact information and communication history, and notes relating to our interactions with you. Our CRM services may synchronize with email accounts to facilitate communication management.

Automatic data collection: we and our Service Providers may automatically log device data (operating system, browser type, screen resolution, device type, IP address, unique identifiers, language settings, and general location such as city or region) and online activity data (pages viewed, time on page, navigation paths, access times, and whether you opened our emails or clicked links). We use cookies, local storage technologies, and web beacons (pixel tags) for this purpose.

2. How We (and Our Service Providers) May Use Your Personal Information

We may use your personal information to: provide and operate our Services and Site, communicate with you, and respond to requests and feedback; manage our relationship with you through CRM tools, including tracking your preferences to provide personalized service; send follow-up communications you have opted into, by phone, email, or SMS; send marketing and promotional communications you have opted into (you may opt out at any time as set out in Section 6); comply with applicable laws, lawful requests, and legal process; protect rights, privacy, safety, and property, enforce our terms, and prevent fraud; and create anonymous data for lawful business purposes such as analytics and research.

3. Use of Artificial Intelligence

We use artificial intelligence (“AI”) and machine learning technologies to provide and improve our Services.

AI-generated content: we may use AI to generate or enhance content on the Site, including property descriptions, blog posts and articles, social media and marketing materials, email communications, and advertising copy. While we review AI-generated content for accuracy, it may contain errors or omissions. Do not rely solely on AI-generated content for important decisions, including real estate transactions, without independent verification.

AI-assisted communications: we may use AI to draft or suggest responses, analyze communication patterns, provide automated responses to common questions, and prioritize incoming communications. A human may review messages before sending, though some automated responses may be sent without individual human review.

AI-based analysis and recommendations: we may use AI to identify opportunities based on your stated preferences, suggest properties matching your criteria, analyze market trends, and optimize communications. These outputs are informational only and are not professional advice.

Your rights regarding AI: you may request information about whether AI was used to generate specific content, request human review of significant AI-assisted decisions, opt out of certain AI-powered features where technically feasible, and provide feedback on AI-generated content. Contact us using Section 12.

4. How We Share Your Personal Information

We do not “sell” personal information as defined under applicable laws. We may share your personal information with: our team, partners, and affiliates to facilitate your interactions with us; our Service Providers (such as hosting, IT, CRM, email delivery, AI services, and website analytics); professional advisors such as lawyers, bankers, auditors, and insurers; authorities where required for compliance, fraud prevention, and safety; and successors in connection with a business transaction such as a merger, acquisition, reorganization, or sale of assets, in which case we will make reasonable efforts to require the recipient to honour this Policy.

Other than as set forth herein, data will not be shared with third parties for marketing or promotional purposes. We will never disclose personal information such as phone numbers and SMS consent to third parties for marketing purposes.

5. Advertising and Tracking Technologies

We may share certain information with third-party advertising platforms, including Meta (Facebook/Instagram) and Google, to deliver targeted advertisements, measure campaign effectiveness, create lookalike audiences, and track conversions. These platforms may collect information through cookies, pixels, and similar technologies, including device identifiers, browsing behaviour, and interactions with our advertisements. We use tracking pixels on the Site to measure content interactions, email campaign performance, and conversions. We participate in interest-based advertising, meaning you may see our ads on third-party websites based on your inferred interests.

6. Privacy Choices and Opt-Outs

Online tracking opt-out: you can block cookies in your browser settings (see allaboutcookies.org), limit advertising ID use in your mobile settings, or use privacy-focused browsers and plugins.

Platform opt-outs: Google (adssettings.google.com), Facebook (facebook.com/about/ads). Industry tools: Digital Advertising Alliance (optout.aboutads.info) and Network Advertising Initiative (optout.networkadvertising.org). These opt-outs are device- and browser-specific.

SMS: reply STOP to any SMS from us to unsubscribe. Email: use the unsubscribe link in any marketing email.

Privacy rights: depending on your location, you may request information about how we have collected and used your personal information, access to a copy of it, correction of inaccurate information, deletion of information we no longer need, and other rights such as objection or withdrawal of consent. To exercise these rights, contact us using Section 12.

7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including legal, accounting, and reporting requirements. Contact and communication records are generally retained for the duration of our relationship with you and a reasonable period thereafter; CRM data is retained while you maintain an active relationship with us unless longer retention is required by law; transactional records may be retained to comply with legal and regulatory requirements; and marketing preferences are retained until you update them or opt out. When no longer necessary, personal information is securely deleted or anonymized.

8. Third Party Services

The Site may contain links to websites and online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. We do not control third-party websites and are not responsible for their actions.

9. Security

We employ technical, organizational, and physical safeguards designed to protect the personal information we collect, following generally accepted industry standards during transmission and in storage. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Children

Our Services are not intended for children under 18. If we learn we have collected personal information from a child under 18 without required consent, we will delete it.

11. SMS Text Messaging Terms of Use

We use SMS text messaging to confirm appointments, send reminders, and notify clients of schedule updates or important changes. You can cancel at any time by texting STOP; we will confirm your unsubscription by SMS. For assistance, reply HELP or contact connect@jatindua.com. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply and message frequency may vary; contact your wireless provider with questions about your plan.

13. Changes to this Privacy Policy and Terms of Use

We reserve the right to modify this Privacy Policy and Terms of Use at any time. If we make material changes, we will notify you by updating the date of this Policy and posting it on this website.

14. Notice of Collection and Additional Rights for California Residents

If you are a California resident, the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA”) provides you with specific rights. In the preceding 12 months, we may have collected: identifiers (name, email, phone number, IP address); commercial information (property preferences, transaction history); internet activity (browsing history, Site interactions); geolocation data (city/region from IP address); professional information (if provided); inferences drawn from the above; and sensitive personal information only if voluntarily provided (such as account credentials).

Requests to know: you may request disclosure of the categories and specific pieces of personal data we have collected about you, our sources, purposes, and any categories of third parties to whom data was disclosed, and retention periods. Requests to delete or correct: you may request deletion or correction of your personal data, which we will honour unless otherwise authorized by law. Authorized agents: you may designate an authorized agent with written permission (or power of attorney) to submit requests on your behalf.

We will acknowledge receipt within 10 business days and respond within 45 calendar days (extendable to 90 with notice). Disclosures cover the preceding 12-month period. We do not charge a fee unless a request is excessive, repetitive, or manifestly unfounded. Non-discrimination: you will not be discriminated against for exercising your privacy rights.

Selling and sharing: we do not “sell” personal data as defined under the CCPA. We may “share” certain information (such as device identifiers and browsing activity) with advertising partners for cross-context behavioural advertising as described in Section 5; you may opt out by contacting us using Section 12. Sensitive personal information: we do not request sensitive personal information except account credentials, used only to provide and secure your account. Do Not Track: we do not currently respond to “Do Not Track” browser signals; however, we honour Global Privacy Control (GPC) signals as valid opt-out requests under the CCPA.
