Short answer

Hire your real estate lawyer before you offer, or at the latest before conditions expire. Ask for an all-in estimate including disbursements, title insurance and HST, who will handle your file, whether they know your type of deal, and whether they are available at closing.

Your lawyer does the part of the deal you can’t see: title, funds, registration and the documents that make the sale legal. A good one also catches problems before they become expensive.

When to hire them

Before you make an offer if possible, and certainly before your conditions expire. A lawyer can review a status certificate, an unusual clause or a survey issue during your condition period, not after.

What to ask

  1. What is your fee, and what are the disbursements? Ask for an all-in estimate: legal fee, title insurance, searches, registration costs, and HST.
  2. Who will handle my file? A lawyer, a clerk, or both, and who you can reach.
  3. Do you handle my type of deal? Condo, new build, assignment, estate sale, private mortgage or a purchase with a leaseback all have their own quirks.
  4. Will you review the agreement before I sign? Some lawyers will, for a fee.
  5. How will you communicate? Email, phone, secure portal, and how quickly.
  6. Are you available on closing day and the days before? Summer and month-end are the busiest periods.

Condition & features

This is where estimates usually go wrong. Two identical floor plans on the same street can sit $250,000 apart on condition alone — be honest here and the number gets a lot more useful.

A range is a starting point.
A strategy is what sells.

This model doesn’t know that your neighbour’s identical semi went $80,000 over asking last month, or which two upgrades actually pay back in your area. That conversation is free and takes twenty minutes.

How this works — your estimate is generated by a model built on recent Toronto & GTA sale data, weighting area, property type, size, age, condition, lot and features. It is an automated estimate for information only. It is not an appraisal, not a Comparative Market Analysis, and should not be relied on for financing, legal or tax purposes. Real pricing depends on comparable sales, interior finishes and market conditions on the day — ask me for a written CMA before you make a decision.

Red flags

  • A very low headline fee with large “disbursements” added later.
  • No clear answer on who handles the file.
  • Unwilling to review conditions or documents before waiver.

For sellers

Your lawyer handles the discharge of your mortgage, the statement of adjustments, and paying out the proceeds. Tell them early about any liens, lines of credit secured on the home, or estate issues.

The takeaway

Choose on clarity and availability as well as price, and get your lawyer involved before you waive conditions.
