Hire your real estate lawyer before you offer, or at the latest before conditions expire. Ask for an all-in estimate including disbursements, title insurance and HST, who will handle your file, whether they know your type of deal, and whether they are available at closing.
Your lawyer does the part of the deal you can’t see: title, funds, registration and the documents that make the sale legal. A good one also catches problems before they become expensive.
When to hire them
Before you make an offer if possible, and certainly before your conditions expire. A lawyer can review a status certificate, an unusual clause or a survey issue during your condition period, not after.
What to ask
- What is your fee, and what are the disbursements? Ask for an all-in estimate: legal fee, title insurance, searches, registration costs, and HST.
- Who will handle my file? A lawyer, a clerk, or both, and who you can reach.
- Do you handle my type of deal? Condo, new build, assignment, estate sale, private mortgage or a purchase with a leaseback all have their own quirks.
- Will you review the agreement before I sign? Some lawyers will, for a fee.
- How will you communicate? Email, phone, secure portal, and how quickly.
- Are you available on closing day and the days before? Summer and month-end are the busiest periods.
