150 Berry Road — also addressed as 1 Neighbourhood Lane — is a completed, registered 10-storey condominium of 234 suites, registered on 21 September 2020, developed by VANDYK.

That building is finished and is a normal resale condominium. What buyers need to understand is the rest of the site. VANDYK went into receivership, and court-ordered receiverships were issued over neighbouring Backyard phases in early 2024. This post separates what is built and registered from what is not, because listings in this area routinely blur the two.

First, correcting something you may have read

This project is VANDYK, not Marlin Spring. I found no source connecting Marlin Spring to 150 Berry Road. Marlin Spring’s verifiable Etobicoke activity is a 5280 Dundas site acquisition near the Kipling Transit Hub, announced in July 2024 — a completely different project. If a listing or article attaches Marlin Spring to Backyard, it is wrong.

Amenities are thin — one database lists only a gym. Fees are reported to include common elements, insurance and water. For a building of this size and vintage a light amenity package is not unusual and, honestly, keeps the fee down.

Transit: a bus stop at Berry Road at Bell Manor Drive, with the Gardiner and Islington Avenue nearby. This is a car-and-bus pocket of Stonegate–Queensway.

The receiverships

This is the part that matters, and it is documented

A receivership order over 25 Neighbourhood Lane — a 10-storey, 134-unit building with 21 unsold units — was issued on 6 February 2024, on lender claims of over $12 million. Reporting at that time stated that eight sites connected to the VANDYK Group had been declared insolvent.

A separate receivership order over 10 Neighbourhood Lane (The Humberside, a completed two-storey commercial building) was issued on 5 March 2024, with msi Spergel Inc. as receiver, following default on a $10 million bridge loan. A sale agreement with Supertrin Commercial Properties Inc. was signed on 14 June 2024, with a court approval hearing set for 14 August 2024. Court filings included roughly $474,792 owed to the City of Toronto in realty tax arrears.

What a receivership does and does not mean for you

I want to be careful and useful here rather than alarming.

  • If you are buying a resale suite at 150 Berry Road, you are buying into a registered corporation that is complete. A developer’s insolvency on a neighbouring parcel does not transfer to a registered corporation’s title. Your risks are the ordinary ones: reserve fund, deficiencies, fees.
  • If you are buying pre-construction or an unregistered unit anywhere in this community, that is a fundamentally different transaction. Deposit protection in Ontario is provided through Tarion, with statutory limits. Understand exactly what is protected and what is not before you sign anything.
  • What genuinely does affect a completed building nearby: an unfinished or stalled site next door can mean years of hoarding, an incomplete streetscape, and amenities or retail that were promised in marketing and never arrive.

If you are looking at anything in this community, get a lawyer to look at the specific parcel and its registration status. This is not a situation to work out from a listing description.

The phase names are a mess — here is what I can and cannot pin down

Marketing sources describe Backyard Neighbourhood as a master-planned community at 188 The Queensway and 150 Berry Road, redeveloping the former Stonegate Plaza, with three residential buildings of 7, 8 and 10 storeys totalling about 505 units, plus a roughly 32,000 square foot commercial building with a health centre and food co-op. Named phases include The Humberside, The Queensview at Backyard, The King’s Mill at Backyard, and a “Backyard Neighbourhood 2.”

The phase-to-address mapping is contradictory across every source I checked. One aggregator assigns The Humberside to 150 Berry Road; news reporting places The Humberside at 10 Neighbourhood Lane. One lists The Queensview at “150 Berry Dr”; another lists it at 25 Neighbourhood Lane.

The only pairing I am willing to publish is: 150 Berry Road / 1 Neighbourhood Lane = TSCC 2805. Everything else, verify against the actual registration before you rely on it. The architect for the community is reported as Kohn Partnership Architects, from a marketing aggregator — a soft source.

The takeaway

The building at 150 Berry Road is finished, registered and perfectly ordinary to buy as a resale. The community around it is not ordinary: VANDYK entered receivership, and two neighbouring Backyard parcels were placed under court-ordered receivership in early 2024. If you are buying registered resale here, that is background you should know but not a reason to walk. If you are buying anything unregistered in this community, get a lawyer on the specific parcel first — the phase names and addresses do not line up consistently in any public source.
